RGPD policy
1) PURPOSE AND METHOD OF PROCESSING PERSONAL DATA
The personal data provided by the interested party (“Data”) will be processed for the following purposes:
- a) Provide access to J'Oceane's content, news and services, in accordance with the terms and conditions provided by J'Oceane.
- b) Allow the company to carry out surveys aimed at improving the quality of the service provided, in the legitimate interest of the company, its subsidiaries and
associated businesses and its sales network (“Customer Satisfaction”); - c) With the authorization of the interested party, send commercial and/or promotional communications about the company's products and services, including
invitations to J'Oceane events and, to conduct market research (“Marketing”); - d) With the authorization of the interested party, analyze their behaviors, habits and propensities to consume, in order to improve products and services
provided by the company, as well as meeting the specific needs of customers (“Profiling”); - e) With the authorization of the interested party, as part of customer profiling, use images of the customer and/or the interested party in order to improve the customer experience
and customer management.
Data processing for each of the above purposes may be carried out in paper, automated or electronic form and, in particular, by ordinary or electronic mail, telephone (e.g. automated calls, SMS), fax and any other computer channel (e.g. websites, mobile phone applications), fax and any other computer channel (e.g. websites, mobile phone applications).
2) CONSEQUENCES OF POSSIBLE FAILURE TO TRANSMIT AUTHORIZATIONS
The transmission of authorizations as referred to in the letters c), d), and e) above is optional. In the absence of transmission of these authorizations, J'Oceane may carry out the activities referred to in letters c), d), and e).
3) OTHER SUBJECTS WHO MAY PROCESS DATA
Data may be processed by subjects acting on behalf of the company and pursuant to specific contractual obligations, in EU member states or non-EU countries. Data may be communicated to third parties to meet some of the legal obligations, to comply with orders from public authorities or to exercise company law in judicial matters.
4) DATA TRANSFER OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)
As part of the company's contractual relationships, data may be transferred outside the territory of the European Economic Area (EEA), also by entering into databases managed by third-party companies acting on behalf of the company. Database management and data processing are linked to the purposes for which they were collected and are carried out in full compliance with applicable laws on the protection of personal data. Whenever data is subject to transfer outside the EEA, the Company will take all appropriate and necessary contractual measures to ensure an adequate level of data protection, including — among others — agreements based on standard contractual clauses for the transfer of data outside the EEA, approved by the European Commission.
5) DATA CONTROLLER AND DATA PROTECTION OFFICER
The data controller is J'Oceane SAS, whose head office is located at via 3 Rue de Concarneau, 94539 RUNGIS CEDEX. The interested party can contact the Data Protection Officer and the company on these issues at the email address rgpd@joceane.fr
6) DATA RETENTION
The data processed to provide the service and for customer satisfaction will be kept by the company for the period considered strictly necessary for these purposes. In addition, the data processed to provide the service may be kept for a longer period of time, in order to manage any possible dispute related to the provision of the service. The data processed for marketing and profiling purposes will be kept by the company from the moment the interested party has given their authorization until the moment when this authorization is revoked. If the authorization is revoked, the data can no longer be processed for the marketing and profiling purposes mentioned above, but may be retained in order to manage any disputes and/or disputes and/or to ensure the safety of the customer. The data retention period for marketing and profiling purposes provided by J'Oceane is in accordance with local regulations and the provisions of the Personal Data Protection Authority.
7) RIGHTS OF THE INTERESTED PARTY
The interested party has the following rights:
right of access, i.e. the right to obtain from the company confirmation that the data is being processed or not and, in this case, to have
access;
- Right to rectification and cancellation, i.e. the right to obtain the correction of inaccurate data and/or the integration of incomplete data
or the cancellation of data for legitimate reasons; - Right to the limitation of treatment, i.e. the right to request the suspension of treatment in case of legitimate reasons;
- Right to data portability, i.e. the right to receive the data in a structured, commonly used and legible format, as well as the right to transmit the data to another data controller;
- Right to object, i.e. the right to object to data processing for legitimate reasons, including data processing for marketing and profiling purposes, if applicable;
- Right to contact the competent data protection authority in the event of unlawful data processing
- Right of access, that is, the right to obtain from the company confirmation that the data is being processed or not and, in this case, to have access to it;
